How the Harmonized System Classifies Chemicals
The HS nomenclature is maintained by the WCO and used as the classification basis by customs administrations in the large majority of world trade. Its core structure is a 6-digit code that is standardized internationally: the first 2 digits identify the chapter, the first 4 digits identify the heading, and all 6 digits together identify the subheading. Individual countries then add further digits — for national tariff-line and statistical purposes — on top of that shared 6-digit international base. Because only the first 6 digits are guaranteed to match across countries, the same chemical can carry a fully identical HS code in one country and a different one, past the sixth digit, in another.
Where Chemicals Sit in the Nomenclature
Most laboratory chemicals fall within HS Section VI, “Products of the Chemical or Allied Industries,” which spans Chapters 28 through 38, including:
- Chapter 28 — Inorganic chemicals; organic or inorganic compounds of precious metals, rare-earth metals, and radioactive elements or isotopes.
- Chapter 29 — Organic chemicals.

Adjacent chapters matter too: Chapter 39 (plastics and articles thereof), in Section VII, covers many labware and consumable items rather than the chemicals themselves, and mixtures or formulated products sometimes classify differently than their principal chemical constituent would suggest.
The U.S. Implementation: HTS and Schedule B
The United States implements the HS as the Harmonized Tariff Schedule of the United States (HTSUS) for imports — a 10-digit code built on the shared 6-digit HS base, published and maintained by the U.S. International Trade Commission (USITC). U.S. Customs and Border Protection (CBP) is the agency that enforces classification, assesses duty, and processes entries, typically filed electronically through CBP’s Automated Commercial Environment (ACE). For exports, the U.S. uses a related but separate 10-digit Schedule B code, maintained by the U.S. Census Bureau’s Foreign Trade Division; it shares the same first 6 digits as the corresponding HTS/HS code but is not identical to it beyond that point, so an import code cannot simply be reused on an export declaration.
Why Procurement and Import Staff Need the Correct Code
An incorrect or missing HS/HTS code on a chemical shipment can cause a customs hold, an incorrect duty assessment (over- or under-paid), or — for repeated or willful misclassification — a CBP penalty action. Correct classification can also determine whether a shipment triggers review by another federal agency at the border (for example, an EPA hold tied to Toxic Substances Control Act (TSCA) inventory status, or a DEA hold tied to controlled-substance or precursor-chemical scheduling). It’s worth being explicit about the boundary here: the HS/HTS code is a customs tariff classification, not a statement that a chemical is TSCA-listed or DEA-scheduled. A reagent can have a completely uncontroversial TSCA and DEA status and still be delayed at the border because its HS/HTS code was wrong, missing, or inconsistent with its declared description — and, conversely, correctly classifying a chemical for tariff purposes doesn’t itself clear it under TSCA or DEA requirements. Procurement and import staff typically need to satisfy all of these requirements independently, not as a single combined check.
How to Determine the Correct Code
- Start from the chemical’s actual identity: CAS Registry Number, IUPAC or common name, and, for mixtures, composition and relative proportions.
- Consult the current edition of the relevant country’s tariff schedule (HTSUS for U.S. imports) and apply its General Rules of Interpretation (GRI), which govern how to classify products that could plausibly fit more than one heading.
- Check whether the product is a mixture or formulated preparation rather than a single defined chemical — these often classify differently (frequently under Chapter 38) than their principal active ingredient would on its own.
- Where classification is genuinely unclear or the shipment is high-value or high-risk, request a binding ruling. In the U.S., CBP’s Customs Rulings Online Search System (CROSS) publishes past binding rulings and is the mechanism for requesting a new one.
- For anything beyond a routine, well-precedented shipment, involve a licensed customs broker — classification liability under U.S. law rests with the importer of record even when a broker prepares the entry.
HS Code vs. Other Identifiers Often Confused With It
Several other identifiers travel alongside a chemical shipment’s paperwork and are easy to mix up with the HS/HTS code:
- CAS Registry Number — identifies the specific chemical substance itself. It is not a customs classification: a single HS subheading commonly covers many different CAS-numbered substances.
- UN Number — a four-digit dangerous-goods identifier under DOT/IATA/IMDG transport rules (see IMDG Code Classes and Packing Group (Hazmat)). It governs how the substance must be packaged and labeled for transport, not what customs duty applies.
