Historically, PVPA covered only sexually reproduced varieties (grown from seed) and tuber-propagated varieties (e.g., potatoes). The Agricultural Improvement Act of 2018 (the 2018 Farm Bill) extended PVPA eligibility to asexually reproduced varieties as well — plants propagated by cuttings, grafting, budding, or tissue culture rather than from seed — which for the first time created direct overlap with the older plant-patent system for that category of plant.
PVP certificate vs. plant patent vs. utility patent
Three separate legal tracks can protect a plant, and they are administered by two different federal agencies with different rules:
- PVP certificate (USDA/PVPO, 7 U.S.C. Ch. 57): covers sexually reproduced, tuber-propagated, and (since 2018) asexually reproduced varieties. Certificate term
A PVP certificate runs for 20 years from its date of issue for most varieties, and 25 years for varieties of trees and vines (including their rootstock). This is measured from the certificate’s issue date, not the application filing date — a distinction that matters when comparing PVPA timing to a utility patent’s 20-years-from-earliest-filing term.
Statutory exemptions: farmer’s exemption and research exemption
PVPA includes two exemptions from infringement that have no direct equivalent under either patent route, and that any tech transfer office licensing a PVP-protected variety needs to account for:
- Farmer’s exemption: a farmer who has legally obtained seed of a protected variety may save seed from their own harvest and replant it on their own operation the following season, without infringing the certificate. This exemption was not extended when the 2018 Farm Bill added asexually reproduced varieties to PVPA — it applies to the original sexually reproduced and tuber-propagated categories, not to the newer asexual category.
- Research exemption: PVPA permits use of a protected variety for plant breeding or other bona fide research, including using it as a source of germplasm to develop a new variety. This is narrower than it may sound — it protects using the variety as research material, not commercializing a variety substantially derived from it without the original breeder’s rights being implicated.
Why this matters for university and ag-research technology transfer
Public land-grant university breeding programs — wheat, soybean, turfgrass, ornamental horticulture, and similar conventional-breeding programs — have historically relied on PVP certificates rather than utility patents for released cultivars, in part because a PVP certificate is generally faster and less expensive to obtain than a utility patent, and in part because the invention (a specific bred variety) fits PVPA’s scope cleanly. A technology transfer office evaluating a new plant-breeding invention disclosure needs to determine, early, which of the three tracks actually fits: whether the variety is sexually reproduced, tuber-propagated, or asexually reproduced (which determines plant-patent eligibility and, since 2018, PVP eligibility for the asexual case); whether the innovation is really the whole variety or an underlying gene/trait/method (which points toward a utility patent instead, per J.E.M. Ag Supply); and whether the farmer’s exemption’s effect on downstream licensing revenue changes the commercialization strategy relative to a patent route that carries no such exemption. Because PVP certificates and utility patents administer through entirely separate federal agencies (USDA/PVPO vs. USPTO) with separate application systems, timelines, and fee schedules, this is also a practical filing-logistics decision, not only a legal-scope one.
Frequently asked questions
Is a PVP certificate the same thing as a patent?
No. A PVP certificate is a distinct certificate-based IP right issued by USDA’s Plant Variety Protection Office under PVPA, not a patent issued by USPTO. It functions similarly to a patent — giving the holder exclusive rights to control propagation and sale of the protected variety for a fixed term — but follows a different statute, a different administering agency, and different statutory exemptions (notably the farmer’s and research exemptions) than either a plant patent or a utility patent.
Can the same plant variety be protected by both a PVP certificate and a patent?
