Yes, the USPTO lets any inventor file a provisional patent application without an attorney — there is no legal requirement to use counsel, and provisional applications have a lower bar than a non-provisional filing: no formal claims, no oath or declaration, no information disclosure statement, and no examination. That low bar is exactly what makes DIY filing risky in a way that is easy to miss. A provisional application only protects what it actually, adequately discloses. What “DIY” Actually Means Here

DIY provisional filing means the inventor personally writes the specification, prepares any drawings, completes the cover sheet, and submits everything through USPTO Patent Center — with no patent attorney or agent drafting or reviewing the document. It is distinct from having an attorney draft the application while you file it yourself, and distinct from using an invention-disclosure service that is not a registered patent practitioner (some of which market themselves in ways that blur this line — the USPTO warns that only attorneys and agents registered to practice before it may render legal patent advice or represent an inventor before the Office).

What a Provisional Application Legally Requires

Under 35 U.S.C. §111(b), a provisional application needs only:

  • A written description of the invention that meets the 35 U.S.C. §112(a) standard — enough detail that a person of ordinary skill in the relevant field could make and use the invention without undue experimentation (“enablement”), plus a description that demonstrates the inventor was actually in possession of the invention as claimed (“written description”).
  • Drawings, where necessary to understand the invention.
  • A cover sheet identifying the application as provisional, naming the inventor(s), and providing correspondence information (USPTO form SB/16, or the equivalent data entered directly in Patent Center).
  • The filing fee.

What it does not require: formal patent claims, an inventor’s oath or declaration, or an information disclosure statement. USPTO Filing Fees

Under the current USPTO fee schedule, the provisional application filing fee is $325 for a large entity, $130 for a small entity, and $65 for a micro entity. Entity size is determined by USPTO’s small-entity and micro-entity criteria, not by the inventor’s personal finances — an independent inventor or a university-affiliated researcher typically qualifies as small or micro entity, but check the current eligibility rules before claiming the reduced fee, since misrepresenting entity status has consequences. How to Actually Submit It

All USPTO electronic patent filing now goes through Patent Center. EFS-Web, the older filing system, was retired on November 15, 2023, and Patent Center is now the only current electronic route (paper filing by mail remains technically possible but is slower and not the practical default). The mechanics of a DIY submission:

  1. Create or use a USPTO.gov (MyUSPTO) account, then access Patent Center.
  2. Start a new “Provisional Application” submission and enter inventor and correspondence information — this generates the cover sheet data the SB/16 form would otherwise capture.
  3. Upload your specification and any drawings as PDF (text-searchable PDF or DOCX is preferred; scanned image-only PDFs are accepted but not ideal).
  4. Select the correct entity status (large, small, or micro) — this determines your fee.
  5. Pay the filing fee and submit. Patent Center issues an application number and official filing receipt; the filing date is the date USPTO received a specification, which can be same-day.

The Real Risk: Written Description and Enablement

This is the part DIY guidance often understates. A provisional application is not examined, so nothing stops you from filing something inadequate — the USPTO will accept it and issue a filing receipt regardless of quality. The consequences only surface later, during prosecution of the eventual non-provisional, or worse, during litigation, when a competitor or examiner argues that the provisional did not actually support the priority date you are relying on.

Two doctrines matter here, both flowing from 35 U.S.C. §112(a):

  • Enablement: the provisional must teach a person of ordinary skill in the field how to make and use the invention without undue experimentation. A description that says what the invention does but not how to build or perform it will not enable it.

When DIY Is Genuinely Reasonable

  • You need a priority date before a specific, imminent disclosure — a conference presentation, a paper, a demo, a sale — and there is no time or budget to engage an attorney first. A same-day, adequately written provisional beats no filing at all.
  • The invention is mechanically simple and singular — one clear embodiment, straightforward to describe completely in ordinary technical language, without complex claim-scope trade-offs.
  • You genuinely intend to bring in a patent attorney before the 12-month non-extendable deadline to prepare the non-provisional, and are treating the DIY provisional as a placeholder that buys time and establishes “patent pending” status — not as a substitute for professional drafting.
  • You can write clear, complete technical prose and are willing to over-describe rather than under-describe: more variations, more alternative embodiments, more detail on how (not just what).

When DIY Risks Losing Patent Rights

  • The invention is complex, chemical, biological, or software-driven with multiple components, parameters, or algorithmic details where the specific claim scope you’ll want is genuinely unclear at filing time — exactly where under-describing is most likely and hardest to self-diagnose.
  • You are unsure who the actual inventors are. Inventorship is a legal determination (who conceived which claimed elements), not a matter of who did the most work or holds the most seniority. Naming the wrong inventors, or omitting one, can create defects that are difficult and expensive to fix later.
  • You are in a competitive or crowded field where narrow, careless claim-scope thinking in the provisional could hand a competitor room to design around your eventual patent.
  • You are relying on the U.S. one-year grace period for your own prior disclosure and are not certain your provisional’s filing date and content line up correctly with the disclosure — this is a fact-specific determination worth professional review.
  • You would only find out about a problem after the non-extendable 12-month deadline has passed — a provisional that turns out to have been inadequately drafted cannot be revived or amended to add new matter after the fact; the 35 U.S.C. §111(b)(5) deadline is absolute.

If You Are Affiliated With a University or Research Institution: Check Your IP Policy First

This is the caution most DIY patent guidance leaves out entirely, and it matters specifically for CASRAI’s audience. Most universities and research institutions require faculty, staff, and often students to assign inventions made within the scope of employment or using significant institutional resources to the institution, under their IP policy or employment agreement — independent of who funded the underlying research. Filing a provisional application personally, in your own name, without first going through your institution’s technology transfer office (TTO), can create a genuine ownership dispute: it does not necessarily give you personal rights to an invention the institution is entitled to, and it can complicate the chain of title if the institution later needs to correct inventorship or ownership on a subsequent filing. If the work was federally funded, Bayh-Dole Act obligations may also require the institution, not the individual inventor, to manage disclosure and election of title.

Before filing on your own, submit an invention disclosure to your TTO and ask directly whether the institution intends to claim ownership. Many TTOs will file (and pay for) the provisional themselves once an invention clears their patentability assessment, which removes both the DIY risk and the ownership question.   1. Confirm whether your employer or institution has a claim to the invention; resolve ownership before filing in your own name.
  2. Identify every actual inventor — everyone who conceived any element that will eventually be claimed — and include all of them on the cover sheet.
  3. Write a written description that explains not just what the invention is, but how to make and use it, in enough detail for someone skilled in the field to replicate it without guesswork.
  4. Describe alternative embodiments and variations, not only the single prototype you built — this is what preserves room for broader claims later.
  5. Include drawings for anything structural, mechanical, or spatial that is easier to show than describe.
  6. Create or confirm your USPTO.gov account, and select the correct entity status (large/small/micro) before paying.
  7. File through USPTO Patent Center (not EFS-Web, which no longer exists) and keep the official filing receipt.
  8. Calendar the non-extendable 12-month deadline immediately — missing it means permanent abandonment with no revival.
