A patent claim chart is a table that maps the individual elements of a patent claim, one by one, against the corresponding features of a specific product, process, or standard. Its purpose is to answer one narrow but consequential question with evidence rather than assertion: does the thing being examined contain every element recited in the claim? That question sits at the center of both patent litigation and technology transfer office (TTO) licensing work, which is why claim charts show up in infringement demand letters, freedom-to-operate opinions, and license valuation discussions alike, not only in courtrooms.

What a Claim Chart Actually Contains

A claim chart is typically a two-column (or multi-column) table. One column lists each element of a patent claim, usually broken into individual limitations by parsing the claim language phrase by phrase. The opposing column identifies, for each element, the specific feature of the accused product, competitor technology, or prior-art reference that is said to correspond to it — supported by citations to source evidence: product documentation, technical specifications, source code, datasheets, teardown photographs, or (for prior-art or invalidity charts) the text of a prior patent or publication.

Claim charts come in several variants depending on what question they’re answering:

  • Infringement claim charts map a patent claim against an accused product to argue the product practices every claim element.
  • Non-infringement claim charts perform the same mapping to argue the opposite — that at least one element is missing.
  • Invalidity (or prior-art) claim charts map a claim against a prior-art reference to argue the claimed invention was already known or obvious before the patent’s priority date.

Why the Format Is Element-by-Element: the All-Elements Rule

The element-by-element structure is not a stylistic convention — it follows directly from how U.S. patent infringement is legally defined. Under the all-elements rule, a product or process infringes a claim only if it contains every element of that claim, either literally or under the doctrine of equivalents. If even one claimed element is genuinely absent (and has no equivalent present), there is no infringement of that claim, no matter how similar the product is overall. The U.S. Supreme Court reaffirmed this element-by-element requirement for the doctrine of equivalents specifically in Warner-Jenkinson Co. v. Before licensing a technology or advising a spinout on commercialization, a TTO or its outside counsel may need a freedom-to-operate (FTO) analysis — checking whether making, using, or selling the technology would infringe someone else’s patent. That analysis is built on claim charts mapping the technology against each potentially relevant third-party claim, since an FTO opinion that isn’t grounded in element-by-element mapping is just an unsupported impression.

Evaluating Inbound Licensing Demands

When a university (or a company it has licensed technology to) receives an infringement demand letter, that letter is frequently accompanied by the patent owner’s own claim chart, offered as the evidentiary basis for the infringement allegation. A well-constructed chart signals a patent owner who has done its homework and is prepared to litigate if licensing negotiations fail; a thin or conclusory chart is itself a signal the position may be weaker than the letter’s tone suggests. Claim charts are ordinarily prepared by patent attorneys or registered patent agents, often with technical input from an engineer or scientist familiar with both the claimed technology and the product being analyzed, since accurately mapping claim language to technical features requires reading the claim the way a person of ordinary skill in the art would construe it. A TTO’s role is typically to commission or review a claim chart prepared by counsel, not to draft one independently — but understanding the chart’s structure lets licensing staff meaningfully evaluate what outside counsel has produced, spot a mapping that looks stretched, and ask informed questions before a negotiating position is set.
